My Update of Week 9 of the 2023 Legislative Session

Week 9 and I can barely believe that the end of March is in sight. I am going to go through withdrawals when this legislative session comes to an end! 

Monday and Tuesday began with IFRW Red Jacket Days at the Capitol. Republican women from across the state came together to vote on delegates for the National Federation of Republican Women Convention in Oklahoma City, Oklahoma this September as well as hear from state and Constitutional officers. It’s always really nice to see so many friends from across the state. We also had the opportunity to enjoy lunch with some of our great legislators!

Tuesday, TVRW hosted an evening with Idaho GOP Chair Dorothy Moon. It was great to have Senator Tammy Nichols, Senator Brian Lenney, Representative Brent Crane, Representative Tina Lambert, Senator Chris Trakel, and Representative Tony Wisniewski join us to give legislative updates. We were also joined by the Kootenai County Republican Women that were in town for Red Jacket Days. What a fantastic way to get an update on what’s happening in Idaho and spend some time with great friends!

 

 

 

 

 

 

 

 

The House wasn’t in session on Monday. They took the day off for a funeral for former Representative Raybold. And then on Friday, both the House and the Senate were primarily off for the day in honor of former Governor, Philip Eugene Batt (March 4, 1927-March 4, 2023). Former Governor Batt served as the 29th Governor of Idaho from 1995 to 1999. He also served as the 35th Lieutenant Governor of Idaho, Chair of the Idaho Republican Party, and a member of the Idaho Legislature. It sure was a much quieter Capitol building at the beginning and ending of the week.

Saturday was a great night with GOP Chair Dorothy Moon & Former Lt. Colonel Matt Lohmeier.

This legislation establishes that members of the State Board of Education be elected and outlines the procedure and qualifications for election. It was introduced in the House State Affairs Committee.

H272 Sex Education Parental Permission is legislation that says a child in public school may not participate in any instruction in sex education without written parental permission. Representative Elaine Price presented the bill in House Education Committee on Wednesday and Thursday.  Some representatives were concerned students wouldn’t learn correct information if they didn’t learn it from their school. They don’t trust the parents. The testimony from Planned Parenthood was the most revealing. DEFINITELY WORTH LISTENING TO! Others were concerned with the injunctive private right of action. They do not want any consequences for anyone breaking any laws. Some said there are already civil actions in the law so no need for penalties. Seems contradictory. McCann and Galaviz don’t like that any employee can be held accountable, they want the school district held accountable. The most disappointing part of the hearing, being censored and not allowed to answer committee members questions. It’s very difficult to sit and watch a chairman allow false information regarding state standards, bill information, and outright facts when this isn’t the case in many other hearings. Unfortunately, the legislative process is very one-sided in the House Education Committee. And, although the Chair would like to make it personal, it’s not personal. Truth is truth, and the people are being silenced while the agencies and the lobbyists are given a very big voice.

S 1151 TRAILER BILL sponsored by Senator Guthrie, amends and adds to existing law to establish provisions regarding the Idaho Launch Grant Program and the Idaho In-Demand Careers Fund. This is a trailer bill to House Bill 24 to impose additional sideboards on the Idaho Launch program. It makes three primary changes: 1) It enhances legislative oversight of the Idaho Launch program to enhance program accountability; 2) It ensures greater “skin in the game” from Launch participants by capping the maximum state match; and 3) It further limits the use of Launch funds to just tuition and fees.

H 225 sponsored by Yamamoto, amends existing law to revise provisions regarding school attendance and to provide for homeschooling.  It was introduced and passed to receive a bill number by 11-4. When the bill was presented in Committee, it was a unanimous voice vote to hold the bill in committee. The actually meat of the bill concerned our Conservative legislators. The statement of purpose read, “Idaho law recognizes public, parochial, private, and homeschool as legitimate forms of education. This legislation clarifies the definition of homeschool as education provided by the parent or guardian wherein all costs associated with home schooling are the responsibility of the parent or guardian.” 

H 226 sponsored by Representative McMann, adds to existing law to provide for an investigation into the residency of a community college trustee and to provide for emergency authority of the State Board of Education when a community college’s accreditation is threatened. The RS introduction passed 9-7 in the House Education Committee, but the bill continues to sit in committee. I’m fairly certain we will see more of the bill or another bill.

Gallagher adds to existing law to enact the Idaho Dietary Supplement Act, which provides that the production, marketing, distribution, sale, and use of dietary supplements that were legal as of July 1, 2022, in Idaho shall remain legal in Idaho, regardless of any changes to federal law or regulation.
